Wellington Land Transfer Office land deeds. Mortgage John MOWLEM to
Samuel WATERS 9 July 1870
This deed made the 9th day of July 1870 between Samuel WATERS of the
City of Wellington mercantile clerk and John MOWLEM of the Wainuiomata
District settler of the other part witnesseth that in consideration of
the sum of £300 on the execution of these presents advanced and lent by
the said John Mowlem to the said Samuel Waters (as he doth hereby
acknowledge) He the said Samuel Waters for himself his heirs executors
and administrators doth hereby covenant with the said John Mowlem his
executors, administrators and assigns that he shall and will pay to
Mowlem £300 on 9 July 1875 and in the meantime pay interest thereon
after the rate of £8 per centum per annum by equal annual payments on
the ninth day of July
Section 153 City of Wellington being lot 4 and part of lot 2 bounded on
the North by part of lot 3... South by lots 5-8... East by Section 155
West by Cuba Street... the southern boundary... is parallel with and
distant one hundred feet from Ingestre Street...

In the late 18th and early 19th century the Mowlem and Burt families
owned stone quarries in the Swanage area. John Mowlem later moved to
London where he was joined in 1835 by Joseph Freeman and George Burt,
son of Robert Burt, a close friend of Mowlem. In 1844 Mowlem too them
into partnership to form Mowlem, Freeman and Burt. Leaving Burt and
Freeman in charge, Mowlem retired to Swanage in 1845 and died in 1868.
Freeman and Burt retired in 1887 when the firm reverted to John
Mowlem and Co.

Palmerston North News. An old established firm of land brokers and
financial agents (Messrs Linton, Mowlem and Mowlem) to-day dissolved
partnership by mutual consent, the senior partner, Mr James Linton,
retiring from the firm, and the two brothers Mowlem continuing the
business. Mr Linton was formerly connected with Mr Thynne (now proprietor
of the Manawatu Herald, Foxton), and were in business some 20
years ago as merchants, land agents, auctioneers, &c. Subsequently Mr
Linton was joined by Fred Mowlem, and still more recently Mr James
Mowlem, both being brothers of Captain Mowlem, well-known in by-gone
years as skipper of the ship Electra and other smart clippers of those

Supreme Court Judgements: Mowlem and Engels
This was an appeal from the determination of Mr Greenfield, S. M., at
Palmerston North, in an action brought by G. Engels, a farmer at
Fitzherbert against Mowlem and Mowlem, land agents, to recover 25
pounds 12s 6d, retained as commission on the sale of property. The
Magistrate gave judgement for Engels for 12 pounds 16s 3d.
Mr Justice Edwards said the inference to be drawn from the facts
stated was that the purchaser was induced to purchase, when he did, by
the apprehension that the property would be sold to another person,
introduced by the appellants. This, His Honour thought, was the meaning
of the Magistrate's statement as to the inference which he drew from
the facts. If he drew any other inference it was not warranted by the
facts, as stated by him. Did this entitle the appellants to claim
commission upon the sale? In His Honour's opinion they were not so
entitled. Whether or not the facts stated were, as had been held by
the Magistrate, sufficient to entitle the appellants to claim against
the respondent for services rendered need not be considered, since the
respondent had not cross-appealed upon that ground. The appeal was
accordingly dismissed with costs 7 pounds 7s.

trading as Mowlem & Co., who lately assigned their estate, have today
filed their petition in bankruptcy.

Masterton, Tuesday. At a meeting of the creditors in the estate of John
Mowlem and Co., held yesterday, resolutions were passed endorsing the
action of Mr J. B. Keith, who was the liquidator before the firm
became bankrupt, in paying several amounts due on stock sold. The
meeting also authorised the payment of the liquidator's fees and law
costs incurred in the administration of the estate, and ordered the
assignee to pay the amount due to the Pahiatua Farmers' Association
on the trust account in connection with the bankrupt firm.

While walking in Wellington some time ago some poisonous substance
entered the eye of Mr F. Mowlem, junr. As a result (says the Manawatu
'Daily Times') one eye has had to be removed entirely, and doubts exist
as to the possibility of saving the sight in the remaining one. Mrs
Mowlem, wife of Captain Mowlem, has also recently submitted to an
operation on her eyes and at present it is problematical whether the
sight will be saved. She is at present staying with the Rev Mr Harper
at Rongatea.

Masterton notes. At the District Court in Bankruptcy. The Assignee
released the estates of F. Haigh, A. F. Thompson, G. F. Broadbent,
G. G. and Barbara Blair, C. Arbon and J. G. Elliott. On the application
of the Official Assignee a compromise of 50 pounds was sanctioned for
a debt of 1,000 pounds alleged to be due by Blair to Mowlem and Co.,
the bankrupt stating that 200 pounds was owing. The Assignee said both
parties had been through the books, but were unable to arrive at a
settlement. An application that costs in Mowlem and Co. v McKenzie be
paid out of the estate was adjourned to next sitting of the Court.

by the Masterton Borough Council.

Palmerston North. An effort is being made to get the Borough Council
to erect four large incandescent lamps, one at each corner of the
Square. The Council admitted it would be a vast improvement. The cost,
however, is estimated at about 100 pounds, and the request was refused.
Messrs Mowlem and Park have since visited the tradesmen in the Square,
with the result that they have received a guarantee of 30 pounds toward
the cost. Strengthened with this promise, the Council will again be
asked to have the work carried out.

Captain Mowlem has received an intimation that his son James has been
promoted to a lieutenancy in Brabant's Horse. Lieut. Mowlem has risen
from the ranks, and after serving as non-commissioned officer has
gained the position of lieutenant in fifteen months.

received information from South Africa, through an indirect source,
that his son Percy Mowlem, who left as bugler with the Sixth Contingent,
is dangerously ill. The Premier has been requested to institute

Disbandment of a Famous Corps
Private letters received by Captain Mowlem from Capetown state that
Brabant's Hose, one of the most noted of the many colonial regiments
raised during the war, has been disbanded, owing to losses in the
field so sadly thinning the ranks that it was not thought advisable
at this stage of the war to enlist men. The regiment took part in some
of the sharpest engagements of the war, including the Wepener affair.
Lieut. Jas. Mowlem, son of Captain Mowlem, has been associated with
the troop practically since its formation, having joined as a trooper.
The troop was composed of two regiments, each 1000 strong, and all
engaged will receive the special medal awarded for the Wepener affair,
in which, it will be remembered, 3000 British troops successfully held
the town for 14 days against 800 Boers.

A pretty wedding that excited a large amount of interest in Palmerston
North on Wednesday this week was that of Miss Agnes Mowlem, second
daughter of Captain Mowlem, to Mr G. A. Ross, of the Stock Department,
Wellington. Both bride and bridegroom have also a large number of friends
in this city. The wedding was solemnised by the Rev. Mr. Lewis, in the
Wesleyan Church, at Palmerston.
Captain Mowlem gave his daughter away. The bride was attended by her
sister, Miss Hilda Mowlem, as bridesmaid, and Mr Spencer acted as best
man. The bride looked exceedingly winsome in her bridal dress of cream
cloth, matched with cream hat. Miss Mowlem wore a box dress of white
muslin. In the evening, the happy pair came down by train to Wellington,
where they are taking up their residence.

Captain John Mowlem, of Palmerston North, who died yesterday, was born in
1840, and went to Palmerstons North in the early days. He was a native of
Swanage, Dorsetshire, and was at one time a well-known navigator in New
Zealand waters, and was master of the barque Electra at 25 years of age.
In 1869 he took up land at Wainuiomata, and after ten years residence on
it he sold his property and settled in the Manawatu district. For 17 years
he was a director of the Palmerston North Building Society, and rendered
service to the town as borough councillor, Coroner, and J.P. He married
a daughter of Mr Hugh Sinclair, Wainuiomata, who survives him. His family
are:- Messrs John and P. Mowlem (South Africa), F. Mowlem (Australia),
Jas. Mowlem and H. Mowlem (who are in different parts of New Zealand),
Mrs Ross (Gisborne), Mrs Gordon Elliott (Featherston) and Misses H. and
V. Mowlem (Palmerston North).

Last week the death took place, in Palmerston North, of Mrs Mowlem, widow
of the late Captain Mowlem. She was 68 at her death, and had been ill
some time. Mr Duncan Sinclair, of Palmerston, was her twin brother, and
they were the first white children born at Wainuiomata.
