In the Name of God Amen I Thomas Green the Elder of the Town of Ware
in the County of Hertford Malster being of sound mind memory and
understanding do make publish and declare this my last Will and
Testament in manner following that is to say In primis I give and
bequeath unto my two sons Thomas Green and Aaron Green the sum of
five hundred pounds apiece as an additional to what I gave them
severally on their respective marriages then I give and bequeath unto
my son Samuel Green the sum of five hundred pounds to be paid within
six Calendar Months next after my decease provided nevertheless that
in case the said son Samuel Green shall happen to die before his said
legacy shall become payable without leaving issue lawfully begotten of
his body then his said legacy shall be void and in such case I give and
bequeath such legacy or sum of five hundred pounds last mentioned unto
my said Sons Thomas Green and Aaron Green and to my Daughter Martha
North equally to be divided between them share and share alike then I
give and bequeath unto my said Daughter the sum of five hundred pounds
to be paid within six Calendar Months next after my decease then I give
and bequeath unto my Executors hereinafter named eight hundred pounds
capital stock of my three and a half per cent annuities of the year one
thousand seven hundred and fifty eight On Trust and to and for the
intents and purposes hereinafter mentioned concerning the same that is
to say that my Executors and the survivor of them his Executors and
Administrators shall and may during the natural life of my Son John
Green require and have the dividends and interest and produce of the
said eight hundred pounds stock to and for their own use and benefit
paying unto my said Son John Green the Weekly sum of Ten Shillings
and Six Pence of lawful money of Great Britain on the Monday in every
week during his natural life the first payment to begin and be made on
the Monday next after my decease and I do hereby will and declare that
the said eight hundred pounds stock and the interest dividends and
produce thereof during the natural life of my said Son John Green
shall be chargeable with and a security for the payment of the said
Weekly sum of Ten Shillings and Sixpence as aforesaid provided always
and my further Will is and I do hereby expressly declare that the said
Weekly sum of Ten Shillings and Sixpence shall from time to time and
at all times be paid into the hands of my said Son John Green only and
that it shall not be in his power to assign over the same or any part
thereof but that the same and every part thereof shall continue and be
during his natural life for his own personal benefit only and for his
certain maintenance in all events and that immediately after the
decease of my said Son John Green then the said stock shall be shared
and divided amongst my said three Sons Thomas Green Aaron Green and
Samuel Green and my said Daughter Martha North share and share alike
and if any of them shall happen to be then dead then and in such case
the share or shares thereof which such of them so deceased would have
had if alive together with the interest and profits thereof from the
decease of my said Son John Green shall go unto and amongst his or her
or their child or children respectively equally to be divided between
such children if more than one share and share alike and to be
transferred or paid to him her or them respectively at his her or
their respective age or ages of twenty one years and in case there
be no such child or children to take the share of any such deceased
Father or Mother or if such and they shall all happen to die before
their respective ages of twenty one years then the same with such
interest and profits thereof from the decease of my said Son John
Green shall go to the survivors or survivor of them my said Sons
Thomas Green Aaron Green and Samuel Green and my said Daughter Martha
North equally to be divided between them if more than one such
survivor share and share alike I give and bequeath unto my Executors
the further sum of three hundred pounds In Trust and to and for the
intents and purposes following that is to say that my Executors or
the survivor of them his Executors or Administrators shall and do as
soon as conveniently can be after my decease invest the said three
hundred pounds in some Public Stock Fund or Government Security and
apply and dispose of the interest and produce thereof when and as the
same shall from time to time arise and be received for the Benefit of
my said Son Samuel Green for and during his natural life in such manner
as they the said Trustees or the survivor of them his Executors or
Administrators shall think fit it being my intention that it shall not
be in the power of my said Son Samuel Green to assign over such interest
or the produce of the said three hundred pounds or any part thereof to
any person or persons whomsoever the same being intended for his
personal benefit only and upon further trust that after the decease of
my said Son Samuel Green then the said three hundred pounds shall go
unto and amongst all such lawful begotten child or children of my said
Son Samuel Green which shall be living at the time of his death equally
to be divided between them if more than one share and share alike and
to be paid to him her or them respectively at his her or their
respective age or ages of twenty one years and the interest thereof in
the meantime to be applied towards his her or their respective
maintenance and in case any such child or children shall happen to die
before his her or their share or shares in the said three hundred
pounds shall become payable then and in such case the share or shares
of him her or them so dying in the said three hundred pounds and in
the interest and profits from thenceforth to arise and be made of the
same shall go unto and amongst the survivor or survivors of them
equally to be divided between them if more than one share and share
alike and to be paid and applied in like manner as his or her or their
original share or shares thereof provided always and my said Will is
that in case my Executors or the survivor of them his Executors or
Administrators shall think it convenient to part with the said
principal sum of three hundred pounds or any part thereof to advance
my said Son Samuel Green in the World or for his better support and
maintenance then it shall and may be lawful for and I do hereby
authorize and impower my said Executors and the survivor of them
his Executors or Administrators so to do anything in this my Will
contained to the contrary thereof in anywise notwithstanding provided
also and my further Will is and I do hereby declare that neither of
the said Trustees nor the Executors or Administrators of either of them
shall be answerable for the Acts Receipts payments and defaults of the
other of them and that each and every of them shall be answerable only
for what he or they shall respectively and actually [?] and no more and
shall not be answerable for the loss of any of those Trust Monies that
shall happen without their wilful neglect or default and that they and
each and every of them shall be reimbursed out of the said respective
Trust Monies all Costs Charges damages and expenses which they or either
or any of them shall sustain expend or be put unto in the Execution or
Management of their Trusts respectively or any matter or thing
concerning the same in any wise howsoever and all the Rest Residue and
remainder of all my Goods Chattels Stocks Monies Securities for Money
and any personal Estate whatsoever or wheresoever and of what nature or
kindsoever not hereinbefore by me otherwise disposed of after payment of
all my debts funeral and other incidental charges and also the said
Legacies hereinbefore mentioned I give and bequeath unto my said two
Sons Thomas Green and Aaron Green equally to be divided between them
share and share alike to and for their own use and Benefit respectively
and lastly I do hereby nominate and appoint my said Sons Thomas Green
and Aaron Green full and whole Executors of this my last Will and
Testament and also Guardian of my said Son Samuel Green during his
Minority and I hereby revoke and make void all other Wills and
Testaments by me at any time or times heretofore made In Witness
whereof I the said Thomas Green the Testator have to this my last Will
and Testament contained in this and the preceding sheet of paper set
my hand only to the said preceding sheet and my hand and seal to this
sheet the twentyfirst day of January in the year of our Lord one
thousand seven hundred and sixty nine. Thos Green signed sealed
published and declared by the said Thomas Green the Testator as and

of our Lord one thousand seven hundred and sixty nine before the
Worshipful William [-----?] Doctor of Laws Surrogate of the Right
Worshipful George Day Doctor of Laws Master Keeper or Commissary of
the Prerogative Court of Canterbury lawfully constituted.

I JAMES GREEN of Ware in the County of Hertford Gent. being I thank
God of sound mind and memory do make publish and declare my last will
and testament in the manner and form following that is to say first I
give & devise all that my freehold Corn Shop & Loft situate at
[Butchery ?] Green in the town of Hertford in the said county of
Hertford with the appurts unto my son James Fordham Green his heirs
and assigns for ever & I give & devise all the rest residue &
remainder of my messuages lands tenements & heredits both freehold &
copyhold whatsoever & wheresoever as well those in possession as in
reversion unto my wife Mary Green her heirs and assigns for ever also
I give to my said son James Fordham Green & my son Thomas Green & my
daughters Mary Green & Ann Green & all & every other child I shall
have born in my life time or in due time after my decease the sum of
one thousand pounds apiece of lawful money of Great Britain to be paid
to them respectively at their respective ages of 21 years & the
interest thereof to be applied to their respective maintenance
education use & benefit in the mean time & if any or [either?] of them
shall die before that same shall become payable the share of him her
or them so dying shall go to the survivors provided always & in case
any or either of my said children shall die before their respective
legacies shall become payable & shall leave lawful issue then & in
that case such child's legacy shall not go to the survivors but to the
issue of such deceased child anything herein (?) contained to the
contrary notwithstanding also I give to my dear Mother Mrs Susanna
Green widow one gold ring of the value of five guineas & to my brother
in law Nathaniel Stonard (?) & my sister his wife & to my brothers
John Green & Edward Green & their respective wives & to my brother
Thomas Green one gold ring each also I give to my father in law Saml
Orgar & Sarah his wife five guineas apiece & to my sister in law
Elizabeth the wife of George Amor (?) of Winniatt (?) Street Saint
Johns Row Clerkenwell (?) London Gent my brother in law James Baker
Orgar & my sisters in law Sarah the wife of George Goater(?) & Ann
the wife of Henry Nicolls (?) & Maria Orgar spinster three guineas
each] also I give to my said brother Edward Green & the said George
Amor (?) the sum of fifty pounds apiece of lawful money of Great
Britain as an acknowledgement for the trouble they may have in the
execution of this my will & I direct that all the aforesaid legacies (
except the legacies given to my children) be paid to the several
legatees clear of the Legacy Duty which duty I direct may be paid out
of the residue of my personal estate & I give & bequeath all the rest
residue & remainder of my moneys securities for moneys goods chattels
& personal estate whatsoever & wheresoever unto my said wife Mary
Green to & for her use benefit & absolute disposal & I appoint my said
wife Mary the guardian of all my children & I appoint my said wife
Mary with my said brother Edward Green & the said George Amor (?)
Exors of this my will & I direct that my exors do if they shall think
proper [--------] any part of my said childrens legacies for putting
them out apprentice to any trades or professions they shall think them
capable of & I revoke all former wills by me made & I declare this to
be my last will & testament In Witness whereof I have hereunto set my
hand & seal the 27th day of March in the year of our Lord 1808 James

for his last Will & Testament in the presence of us who subscribe our
names as witnesses thereof at his request in his presence & in the
presence of each other the word amended in the fourteenth line from
the top of the first page being first struck out & the word thousand

Codicil to the last Will & Testament of me James Green of Ware in the
County of Hertford Gent whereas I have by my said Will appointed my
wife Mary Green my brother Edward Green & Mr George Amor(?) of
Winniatt (?) Street St Johns Row Clerkenwell London Exors thereof & I
have given to my said brother Edward Green & the said George Amor
fifty pounds apiece for the trouble they may have in the execution of
my said Will now I do hereby revoke the appointment of the said George
Amor as one of my Exors & I hereby also revoke the said legacies of
fifty pounds apiece given to them the said Edward Green & George Amor
& I hereby appoint my brother Thomas Green one of the Exors of my said
Will in the place & stead of the said George Amor to act with my said
wife & my said brother Edward Green & I direct that the gold rings
given by my said Will to my said brothers Edward Green & Thomas Green
be of the full value of five guineas each & I confirm my said Will in
all respects where not altered or revised by this Codicil & I declare
this a Codicil to my said Will In Witness whereof I have hereunto set
my hand & seal the first day of Decr (?) in the year aforesaid 1809
