Archives NZ Wellington Ref: AAOM 6029 5663 (1897) Will dated 28 Aug 1894 Affidavits 16 Sep 1897 Probate granted 1 Oct 1897 This is the last Will and Testament of one Frederick Walter Cooke of Motueka in the Province of Nelson in the Colony of New Zealand Bank Agent I give, devise and bequeath all my real and personal estate whatsoever and wheresoever situate unto my wife Evelyn Mary Cooke absolutely And I appoint my said wife sole executrix of this my Will - In witness thereof I the said Frederick Walter Cooke have hereunto set my hand this twenty eighth day of August one thousand eight hundred and ninety four. Affidavits: I, Evelyn Mary Cooke of Waipukurau in the Provincial District of Hawkes Bay and Colony of New Zealand widow make oath and say:- 1. That I knew the said Frederick Walter Cooke deceased when alive he being my husband and that the said deceased was resident at Waipukurau aforesaid within this District and that the said deceased died at Waipukurau aforesaid on the 7th day of September 1897. 2. That I believe the paper-writing now produced to me and marked "A" bearing date the 28th day of August 1894 to be the last Will and testament of the said Frederick Walter Cooke deceased. 3. That I am the Executrix and sole Devisee and legatee named in the said Will. 4. That I will faithfully execute the said Will by paying the debts and legacies of the said deceased as far as the property will extend and the law binds. In the Supreme Court of New Zealand Wellington District Be it known to all men that on this first day of October 1897 the last Will and Testament of Frederick Walter Cooke formerly of Motueka in New Zealand but late of Waipukurau in New Zealand Bank agent who died on the seventh day of September 1897 deceased, a copy of which is hereunto annexed, hath been exhibited, read and proved before His Honour Worley Bassett Edwards, Esquire, a Judge of this Honourable Court and Administration of the Estate, Effects and Credits of the said deceased hath been and is hereby granted to Evelyn Mary Cooke the widow of the deceased the Executrix in the said Will named, being first sworn faithfully to execute the said Will by paying the debts and legacies of the deceased as far as the property will extend and the law binds. Given under the Seal of the Supreme Court at Wellington this first day of October one thousand eight hundred and ninety seven.
