Conveyance Thomas M. McLaughlin to J. Chambers and another (2A 1302)
Part of Allotment 2, Section 6, Auckland Suburbs
[Corner Mt Eden Road & Burleigh Street, Auckland]
This deed made the seventeenth day of May in the year one thousand
eight hundred and eighty between Thomas Morris McLaughlin formerly of
Auckland in the Provincial District of Auckland in the Colony of New
Zealand but now of parts beyond the Seas Gentleman of the one part and
John Chambers merchant and Seering Hall Matthews accountant both of
Auckland aforesaid of the other part Witnesseth that in consideration
of the sum of two hundred and forty pounds paid by the said John
Chambers and Seering Hall Matthews to the said Thomas Morris
McLaughlin (the receipt whereof is hereby acknowledged) He the said
Thomas Morris McLaughlin doth hereby convey and assure unto the said
John Chambers and Seering Hall Matthews their heirs and assigns All
that piece or parcel of land in the said Provincial District being
part of allotment two of section six of the suburbs of Auckland
Parish of Waitemata and County of Eden.
Bounded on the North by other part of said allotment one hundred and
seven feet three inches; on the east by Burleigh Street laid out
through the said allotment one hundred and seventy nine feet and on
the south west by Mount Eden Road two hundred and seven feet be the
said several admeasurements a little more or less as delineated by
the plan drawn hereon edged red With all the rights and appurtenances
thereto belonging to hold the same unto the said John Chambers and
Seering Hall Matthews their heirs and assigns for ever And the
said Thomas Morris McLaughlin doth hereby for himself his heirs
executors administrators and assigns covenant with the said John
Chambers and Seering Hall Matthews their heirs and assigns That the
deeds specified in the Schedule hereto shall from time to time and at
all times hereafter (inevitable accident alone preventing) be produced
in New Zealand as occasion shall require but at the request and costs
of the said John Chambers and Seering Hall Matthews their heirs or
assigns And that at the like request and costs true and attested
copies of the said deeds or either of them shall be given to the said
John Chambers and Seering Hall Matthews their heirs or assigns And
that the same shall be kept safe whole and undefaced In witness
whereof the said parties have hereunto subscribed their names.

Signed by James Burtt of Auckland aforesaid Gentleman for in the name
and as the act and deed of the said Thomas Morris McLaughlin under
and by virtue of a certain deed poll or power of attorney under the
hand and seal of the said Thomas Morris McLaughlin bearing date the
ninth day February one thousand eight hundred and sixty nine and
deposited in the Deeds Register Office at Auckland aforesaid as number
4555 in the presence of Thos Buddle, solicitor, Auckland and
Thomas Morris McLaughlin by his attorney James Burtt
In the matter of "The Powers of Attorney Act 1854" I James Burtt
of Auckland in New Zealand Gentleman do hereby solemnly and sincerely
declare that I have not received any notice or information of the
revocation by death or otherwise of the deed poll or Power of Attorney
referred to in the attestation clause to the deed written hereon And
I make this solemn declaration conscientously believing the same to
be true and by virtue of an Act of the General Assembly of New
Zealand intituled "The Power of Attorney Act 1854"
Declared at Auckland aforesaid this seventeenth day of May one
thousand eight hundred and eighty before me Thomas Buddle Notary
Public Auckland.

This deed made the thirtieth day of September one thousand eight
hundred and ninety one between Seering Hall Matthews accountant and
John Chambers Agent both of Auckland herein called the "Vendors" of
the one part and Thomas Cranwell of Mount Eden Suburbs of Auckland
in the Provincial District of Auckland Teacher of Music and John
Frederick Colegrove of Auckland aforesaid salesman herein called
the "Purchasers" of the other part Witnesseth that in consideration
of the covenant herein contained for payment of the sum of two
hundred and fifty pounds being the consideration for these presents
They the Vendors do and each of them doth hereby convey and assure
unto the Purchasers their heirs and assigns All that piece of land
in the Provincial District of Auckland being part of allotment two
of Section Six of the Suburbs of Auckland Parish of Waitemata
and County of Eden Bounded towards the North by other part of said
allotment two One hundred and seven feet three inches towards the
east by Burleigh Street laid out through the said allotment one
hundred and seventy nine feet and towards the south west by Mount
Eden Road two hundred and seven feet Be the said several
admeasurements a little more or less as delineated by the plan drawn
hereon edged red With the chapel thereon erected known as the Mount
Eden Baptist Chapel and all the rights ways and appurtenances thereto
belonging To hold unto the purchasers their heirs and assigns for ever
as joint tenants subject however to a certain Deed of Mortgage dated
on or about the sixteenth day of October one thousand eight hundred
and eighty registered as No. 66898 in the Deeds Register Office at
Auckland from the Vendors to the Auckland Savings Bank to secure the
repayment of the sum of two hundred and fifty pounds and interest as
therein mentioned And the purchasers for themselves and each of them
their and his heirs executors administrators and assigns hereby
covenant with the Vendors their heirs executors and administrators
that they the Purchasers their heirs executors administrators or
assigns will pay the said sum of two hundred and fifty pounds and all
interest henceforth to become payable on account thereof and will at
all times hereafter effectually indemnify the Vendors their heirs
executors and administrators from and against the payment of the said
sum of two hundred and fifty pounds and all interest henceforth to
become payable on account thereof as aforesaid and from and against
all actions suits proceedings claims and demands on account thereof
And it is declared that no covenant for or warranties of title shall
be deemed to be implied herein as against the Vendors except only a
covenant that they have not encumbered the said property otherwise
than by the aforesaid Deed of Mortgage for two hundred and fifty
pounds and not further or otherwise In Witness whereof the said
parties have hereto subscribed their names
