Nz's much vaunted "clean" 'halls of justice' are more than a bit tainted. The two "pillocks" with the acid rain are Terrence Arnold, now head "sherang" of the Supreme Court, where there is no right of Appeal [left center] and David Collins Solicitor-General, head of the Crown Law Office. Attorney General, Michael Cullen [bottom] and Prime Minister Helen Clark [top]. Clark and Cullen are both in the corrupted "system." albeit by default. I ain't giving up  ever.  Got my "tee shirt" years ago in the Anti TV tax Campaign. Justice Arnold has been proven a crook in his handling of the Rob Moodie ~ Berryman Bridge disaster. Why ? Because he tried his darndest to keep the 'Butcher Report' off the 'net.   He should not have gone to bed so early. It had been on the 'net for at least six hours when he got up next morning. By then many NZ webmasters had already got the report. I had contacted a few telling them what was going on the 'net and when.
Justice Mallon's decison was due before Xmas 2007 but Justice Arnold put a hold on it as there were outstanding Court fees.
Despite these fees being paid Justice Mallon's decision was not "in the public domain" Well it is now ... 4th May 2008

Justice Arnold
As Solicitor General before 2005, he was instrumental in withholding the 'Butcher Report' from evidence in the Berryman bridge disaster. This report revealed the Army's culpability in the faulty construction that caused the collapse of the bridge and the death of a local beekeeper. The Army instead submitted a sanitized report into evidence which expunged the relevant causations.
As a result, the Army (government) has so far dodged responsibility. Justice Arnold was appointed to the Court of Appeal by the government shortly
afterward in a widely recognized "quid pro quo" for a job well done.
Miscellaneous:
Lawyers are taught to lie but, in the case of Mr. Arnold, his close association with criminal elements in his legal practice is considered by many to have created in him a moral detachment from the law and a blurring of the line between right and wrong. Where Mr Arnold's interests are concerned, he will always find a law to support it, even if it requires him making one up. While (unfortunately) accepted behaviour for a lawyer, this is a particularly dangerous attribute for a Court of Appeal judge where litigants have no direct right of appeal to the newly formed New Zealand Supreme Court. 

 Seems the more important the position the worse the corruption gets.
New Zealand's Governor General Bahjarama, or some such name, was responsible for the anhilation of Derek and Enid Cately's livelihood.

Justice Wild was the judge who ordered the 'Butcher Report' - a piece by damning piece investigative report - that showed the NZ Army was negligent in a King Country bridge collapse that killed a man in 1994 - was kept out of evidence, and thereby allowing the Army to submit its own report that whitewashed this vital evidence.

Farmer's $5000 saves Moodie from prison

A high-country Canterbury farmer has come up with $5000 to pay Rob Moodie's court fine, saving the lawyer, formerly known as Miss Alice, from prison.Dr Moodie was suspended from practising for three months and fined after he was found guilty of contempt two weeks ago by the High Court in Wellington for releasing the Army's suppressed Butcher Report to the media in 2005.
The report, produced by a civil engineer for the Army's 1994 court of inquiry into the collapse of the bridge it had built for King Country farmers Margaret and Keith Berryman, listed serious design and construction faults that had led to the death of beekeeper Kenneth Richards.
Although the report placed responsibility on the Army for the collapse, the Army failed to tell the 1997 coroner's inquest about it, instead claiming under oath that "there was nothing in the entire construction of the bridge that contributed to the accident".

When he received the decision, Dr Moodie changed his name back from Miss Alice - a name he donned ... wearing women's clothing, to protest against what he said was the patriarchal nature of the judiciary - and threatened to give up law.
He also vowed he would never give a cent to the Ministry of Justice and said he would go to jail first.
Shearer and high - country farmer Mark Feary of Oxford paid the fine.
Mr Feary said he paid it because "the Crown, in the form of the military, and latterly Her Majesty's courts, are practising and promoting anarchy in their treatment of the Berrymans and Dr Moodie."
Mr Feary said he was relieved Dr Moodie had changed his mind about retiring from law."We urge the public to do whatever they can to help bring this travesty of justice, not only to the Berrymans but also to Rob, to an end."

Dr Moodie said "It's nice to get the fine out of the road because what would have happened is that some "dickhead" from the courts would have wanted to be 'the man' that put me behind bars."

In a not unrelated development, the Australian Supreme Court last year refused to allow the extradition of a defrocked catholic priest to NZ to face sexual abuse charges, saying there were legitimate concerns about his getting a fair trial.

Prime Minister Helen Clark says the offer of $150,000 is ' still on the table ' but she will not or cannot define what this amount is to cover. It is peanuts. The NZ Army has knowingly told lies saying the bridge was well made. This has been proven to be crap. Dr Robert Moodie has borne the brunt of this corruption backed up by a dedicated team of helpers. A Judge has turned down a Defence Force request that could have blocked Keith and Margaret Berryman from pursuing a second inquest into the death resulting from the collapse of a bridge leading to their farm.
 The Defence Force wanted the Berrymans to give security for costs they might have to pay if their case against it fails. But a Judge in the High Court at Wellington, week ending 17 Aug, refused to make the order. Justice Jill Mallon said if security was ordered it seemed a "real prospect" that the Berrymans could not carry on with their claim, due to be heard next month [4 to 6 September 2007]
 They want the High Court to review the solicitor-general's decision not to hold a new inquest.
 They also want a judgment against the Defence Force for allegedly misleading the coroner who held the inquest into Ken Richards' death in the bridge collapse in 1994.
 Justice Mallon said whether the army wrongly withheld information was matter of public interest. The Berrymans had filed papers saying they could not pay costs, and already owed costs for associated cases. They said they had become impoverished because of Crown conduct that was at the center of the court case.

"A government that won't hesitate to perscute one of it's citizens is a government that
won't hesitate to persecute all of it's citizens, jews, negroes, protestors or otherwise."

Dr Rob Moodie was wrongly found guilty in the Wellington High Court earlier this year, of publicising one "confidential" Government document, resulting in a fine of $5,000 and barred from practicing law for three months. {this was the Butcher Report on the bridge collapse ... which, incidentally, has been wallpapering Mother Earth since midnight 11 April 2005 }

Proof of this wrongful virdict is evidenced by the fact that, Karen and Mark Feary, from 19 July 2007 did the same thing as Dr Rob Moodie, by publicising not one but eight "confidential" Government documents, which the Government is powerless to do anything about. In fact the Government has now even told them to stop publicising their precious "confidential" documents.
We will continue publishing more of their "confidential" documents to show,amongst other things, how the Government from the Prime Minister down, does not hesitate to single out and persecute such people as Dr Moodie. "Confidential" documents will be rotated on and off this site as there are many of them.

 Canterbury man Mark Feary says he wants to be charged with contempt like Dr Moodie because it would "expose the ugliness of what is going on"
 Dr Moodie's clients, Keith and Margaret Berryman, have written to the Solicitor General, saying the lack of action against Mr Feary and his wife, Karen, shows Dr Moodie and the Berrymans were being persecuted.
 " Either the Fearys should also be prosecuted for contempt, or Dr Moodie should receive compensation and an apology, " the Berrymans wrote to the solicitor-general _ week ended 21 July 2007
 A spokesman for Crown Law which the solicitor general heads, declined to comment.
 The Berrymans and Fearys met more than ten years ago. Mr Feary said, 23 July 2007, that the oppressed grouped together.
 The Berrymans' fight is for a new inquest for a man who died when a bridge leading to their King Country farm collapsed in 1994, and compensation for their later legal problems and loss of their farm. The couple's battle for compensation continues.
 Mr Feary's family leased a high country farm for generations before a dispute began with the Crown in 1984, and they were denied access to the property in 1998.  Mr Feary paid the $5,000 fine imposed on Dr Moodie when he was found guilty of contempt of court.
 Dr Moodie had published an engineer's report relating to the Berryman case, having earlier accepted the terms of an agreement to keep it confidential.

 Three High Court judges also found he (Mr Feary) had broken the usual rule that documents obtained from an opposing party as a result of court proceedings could not be used for any ulterior or collateral purpose.
 The Feary's have an arbitration agreement with the Commissioner of Crown lands, which the commissioner says includes an obligation to keep the arbitration process confidential. When Mr Feary sent copies of a valuation report obtained as part of the arbitration to various newspapers, Federated Farmers and others, Crown lawyer Hamish Hancock wrote to the Feary's lawyer emphasising confidentiality.
 Mr Hancock said the commissioner, whom he represented in the Feary's dispute, did not want the partie's energies directed to unproductive side issues. Mr. Feary's response was to release another document.

The $10,000 we got through a previous request enabled us to carry the fight for Justice to where we are now. The NZ Justice system requires 'up front' payment when lodging a case plus surety for costs. We are now at the business end of this protracted, I would say corrupt, process. Success or failure will be known when the two cases outstanding are settled. These are the Statement of Claim and the Application for Judicial Review. Please scroll down to them. I like many other Kiwis are fuming over the numerous miscarriages of natural Justice that have taken place in New Zealand over the recent past. The David Bain fiasco would probably be tops due to the years he spent in jail. His 'case' ending up at the Privy Council in London. Even then the NZ Court system "choked" on the decison / recommendation. Visitors can add their own instances.
Seems most contentious cases going through the NZ Court system are up against a brick wall. I have seen it first hand over the NZ TV LiSence racket. I stuck to my guns through six Court appearances and was rewarded with 80 hours of periodic detention. As my "offence" was Civil not Criminal I am perhaps, the only person in NZ with paper record of my "holiday." The PD center computer system could not handle a civil case. I soon discovered PD was indeed a holiday. It merely took one's free time ... one day a week for me for ten weeks. I could say a lot more about PD but it would detract from the main purpose of this site.

The NZ Government's anhilation of the livelihood of Keith and Margaret Berryman a twice award winning farming couple typifies the rort perpetuated through the NZ Justice 'system' which is choking on one particular Berryman ~ Moodie case since it is for the thick end of $4.2 million. We have had one successfull hearing of note and that was Justice Mackenzie ruling the "Judicial Review" not be struck out. Read it here:   Justice Mackenzie's High Court Judgement 17 May 2006 It's a long, and thorough, decision and at the end we still have a foot in the Treasury safe. Relates to a 'pleading' to a 'strike - out' application by the Solicitor General.

Dr Moodie was in Wellington High Court on 22nd May 2007 and finally the Butcher Report has been "discovered."
I started uploading at 11.55 pm 11 April 2005 and finished at 1 a.m 12 April 2005. [28.8 modem in those days !]
This means it is now officially A O K ... such are the vagaries of the NZ Court System.
    The Crown and Defence Force did not come up with other documents Dr Moodie had requested so he is going back for them. The Government's undefined $150,000 "still on the table" can be stuck up your Jacksee's.

These few pages supplied Dr Moodie with detailed information as to why the bridge failed after only eight years. The Butcher Report is the reason for the Court cases the 'doc has been involved in on behalf of the Berrymans. Had I just uploaded the Butcher Report there would have been nothing to tie it's release to Dr Moodie. He could have then written his narrative after "finding it" on the 'net and offering his service to the Berrymans. Next time perhaps ... if there is one.
